What if I Have a Warrant?

If there is an active warrant for your arrest, you will need to turn yourself in to the Sheriff's Office. You can do this by going to the Sheriff's Office in person or by calling 413-443-7220 to arrange a time to surrender.

If you fail to turn yourself in, you may be arrested by the police.

What if I Am Not Sure if I Have a Warrant?

If you are not sure if there is a warrant out for your arrest, you can contact the Sheriff's Office or visit the Trial Court website to check. It is always better to be safe than sorry, so it is a good idea to check if you have any outstanding warrants before traveling or applying for a job.

Bond Information

What is a Bail Bond?

A bail bond is a guarantee to the court that the defendant will appear for all scheduled court hearings. The bond is typically posted by a bail bondsman, who charges a fee for their services.

How to Post a Bond in Berkshire County

To post a bond in Berkshire County, you will need to contact a bail bondsman. There are many bail bondsmen in Berkshire County, and you can find a list of them on the Sheriff's Office website.

Once you have contacted a bail bondsman, they will need to collect the following information from you:

  • The defendant's name
  • The defendant's date of birth
  • The defendant's Social Security number
  • The defendant's address
  • The defendant's charges
  • The amount of the bond

The bail bondsman will then contact the Sheriff's Office to verify the information and to post the bond. Once the bond has been posted, the defendant will be released from jail.

What if I Can't Afford to Post a Bond?

If you cannot afford to post a bond, you may be eligible for a release on personal recognizance (ROR). ROR means that you will be released from jail without having to post a bond, but you will be required to sign a promise to appear for all scheduled court hearings.

To be eligible for ROR, you must meet the following criteria:

  • You must not be a flight risk.
  • You must not be a danger to yourself or others.
  • You must have a stable residence.
  • You must have a job or other means of support.

If you are granted ROR, you will be required to sign a release form and to provide the court with your address and phone number. You will also be required to attend all scheduled court hearings.

If you fail to appear for a scheduled court hearing, your ROR may be revoked and you may be arrested and jailed.

Sex Offender Registry

The Berkshire County Sheriff's Office maintains a Sex Offender Registry in accordance with the Massachusetts Sex Offender Registry Board (SORB). The registry contains information about individuals who have been convicted of certain sex offenses.
